Esprit Talent Terms & Conditions

1. Introduction

Welcome to the Esprit Talent International Recruitment Service (hereinafter referred to as the “Service”). This Service is provided by Esprit Talent (hereinafter referred to as the “Company”). By using the Service, you (hereinafter referred to as the “User”) agree to be bound by these terms and conditions (hereinafter referred to as the “Terms”). If you do not agree to these Terms, please do not use the Service.

2. Definitions

For the purposes of these Terms, the following terms shall have the following meanings:

  • “Candidate” means an individual who is registered with the Service for the purpose of finding employment.
  • “Client” means an organization that is registered with the Service for the purpose of finding Candidates.
  • “Service” means the Esprit Talent International Recruitment Service, including the website and all other related services.
  • “User” means any individual who uses the Service.

3. Eligibility

The Service is available to Users and Clients who are 18 years of age or older and who are resident in a country where the Service is available.

4. Registration

To use the Service, Users and Clients must register for an account. As part of the registration process, Users and Clients will be required to provide certain information, including their name, contact information, education details and work experience.

5. Use of the Service

Users and Clients agree to use the Service in accordance with these Terms and with all applicable laws and regulations. Users and Clients agree not to use the Service for any unlawful or unauthorized purpose, including, but not limited to, the following:

  • Posting any false or misleading information.
  • Infringing on the intellectual property rights of others.
  • Transmitting any viruses or other malicious code.
  • Engaging in any discriminatory or harassing behavior.
  • Posting any prohibited content (as defined in Clause 7 below).
  • Posting any content that violates the Australian Migration Act 1958.

6. Fees

The Service is free to use for Candidates. Clients are charged a fee for using the Service which will be agreed in writing prior to each engagement.

7. Prohibited Content

Users and Clients agree not to post any of the following prohibited content on the Service:

  • Hate speech
  • Discrimination
  • Violence
  • Pornography
  • Defamation
  • Spam
  • Any content that violates the Australian Anti-Discrimination Act 1977.

8. Confidentiality

Users and Clients agree to keep all information that they obtain through the Service confidential. This includes information about Candidates, Clients, and other Users. Users and Clients agree not to disclose any confidential information to any third party without the prior written consent of the Company.

9. Limitation of Liability

The Company is not liable for any damages arising out of the use of the Service, including, but not limited to, direct, indirect, incidental, consequential, or special damages.

10. Termination

The Company may terminate a User’s or Client’s account at any time, for any reason, without notice.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Australia. The courts of Australia shall have exclusive jurisdiction over any disputes arising out of these Terms.

12. Changes to the Terms

The Company may change these Terms at any time. Any changes to the Terms will be posted on the Company’s website. Users and Clients are responsible for reviewing the Terms regularly to stay informed of any changes.
